On September 20, 1978, we abated the appeal in an unpublished per curiam opinion in order that the record might be approved in accordance with Article 40.09(7), Vernons Ann.C.C.P., and so that briefs might be filed in the trial court. The record has now been properly approved, and briefs have been filed; consequently, we reinstate the appeal for consideration on the merits.
